Terms of use
These terms apply to every use of the NEVERMIND site and to every purchase made on it. Browsing or buying is agreement to the terms below. This document is not legal advice, and it does not take away any right the law gives a consumer. If a term here conflicts with the Israeli Consumer Protection Law, 5741-1981, or any other law, the law prevails.
General
The site is operated by NEVERMIND(“the site”, “we”).
Use of the site
Do not use the site for an unlawful purpose, interfere with it working properly, or try to reach its systems without permission. We may limit or stop access for someone who breaks these terms.
The pieces
What is shown on the site is clothing. The description, the sizes, and the cloth are given as they were given to us. There can be small differences between the piece itself and its description, as the next section explains.
Photographs and colour
Product photographs are for illustration. The colour you see can shift a little with the light in the photograph, the calibration of the screen, and the conditions of the shoot. A slight shift in colour is not necessarily a defect.
Prices and VAT
Every price on the site is in new Israeli shekels (₪) and includes VAT as required by law, unless it says otherwise. The price that applies to an order is the price shown on the site when the order is actually completed.
Orders and confirmation
Completing an order depends on full payment and on the payment provider approving the transaction. An automatic confirmation that the order was placed is not necessarily a final confirmation that it will be supplied. We may get in touch to complete details or, in unusual cases (for example a suspected false order or a stock error), cancel an order and refund everything paid for it.
Stock
We try to keep the stock shown on the site current. If a piece that was ordered is not actually available, we will get in touch and offer an alternative, a credit, or cancellation of the order, according to what you choose.
Payment
Payment on the site goes through Shopify's secure checkout and the payment provider connected to it. Card details are not collected, stored, or processed by the site itself — see “Payment information” on the privacy policy.
Shipping
Where we ship, what it costs, and the estimated delivery times are on the shipping, cancellation and returns page.
Cancelling a purchase
The right to cancel, including when and on what terms, is on the shipping, cancellation and returns page, and follows the Israeli Consumer Protection Law, 5741-1981.
Returns and exchanges
The conditions for a return or an exchange, including the condition a piece must be in, are on that same page. A piece should come back, as far as possible, in its original packaging and unused, except when it is returned because of a defect.
Defective pieces
If a piece arrives with a defect, call 050-299-9921 as soon as you can so we can look into it and arrange a return or an exchange. In the case of a defect, there is no cancellation fee.
Refunds
If a refund is approved, it goes back to the payment method used for the original purchase, on the timetable set by law. When the refund actually appears on the account also depends on the card issuer or the bank, and can take longer than the day we send it.
Promotions and coupons
Promotions, discounts, and coupon codes are valid on the terms published with them when they are running. We may change or stop them at any time, as long as that does not affect orders already placed.
Intellectual property
Everything on the site — including the design, the text, the logo, and the photographs — belongs to NEVERMIND or is shown under licence. It may not be copied, distributed, or used commercially without prior written permission.
Privacy
How information given on the site is used is set out in the privacy policy.
Limitation of liability
The site and its contents are shown as they are (“AS IS”). Where the law allows it, we are not liable for indirect, consequential, or special damage from use of the site — except where consumer law says otherwise and that cannot be waived.
Force majeure
We are not liable for a delay or a failure that comes from circumstances reasonably outside our control, including infrastructure failures, natural disaster, regulatory limits, or a disruption in a third-party service (including Shopify and the payment provider).
Law and jurisdiction
These terms are governed only by the law of the State of Israel. Exclusive jurisdiction in any dispute lies with the competent courts of the Central District, without taking away any jurisdiction that mandatory law gives the consumer.
